Terms of Service

Welcome to ClearEats. By downloading, installing, or using our mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By downloading, installing, or using the ClearEats app, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of App

ClearEats is a local-first food management application that provides the following features:

• Scanning and capturing expiration dates from food packages using AI
• Allergen detection and tracking from food labels (optional, Premium feature)
• Virtual "fridge" storage for organizing food items locally on your device
• Expiration notifications to help reduce food waste
• Automatic or manual expiration date entry
• Bulk scanning capabilities for shopping carts
• Recipe generation based on your fridge contents (Premium feature)
• Nutrition analysis (Premium feature)

All data is stored locally on your device. The App does not require an account or internet connection for core features, though AI features require internet connectivity.

3. No Account Required

ClearEats does not require you to create an account. The app works entirely on your device without login credentials. Your subscription status (if you purchase Premium) is managed through Apple's App Store and linked to your Apple ID.

4. Subscription Plans and Token System

4.1 Free Tier

The free tier includes:

• 10 AI tokens per week (resets every 7 days)
• Manual item entry (unlimited)
• Basic expiration tracking
• Local push notifications
• Basic fridge organization

Each AI-powered action consumes 1 token: expiration date detection (if AI is needed), allergen detection, bulk cart scanning, recipe generation, or nutrition analysis.

4.2 Premium Subscription

The Premium subscription provides:

• 100 AI tokens per week (resets every 7 days)
• All features from the Free tier
• Custom recipe generation based on your fridge contents
• Recipe storage
• Comprehensive nutrition analysis with charts
• Bulk shopping cart scanning
• Allergen detection feature (must be enabled in Settings)

4.3 Billing and Payment

Premium subscriptions are billed monthly at $3.99/month through Apple's App Store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You may cancel your subscription at any time through your Apple ID account settings or the App Store.

4.4 Refunds

Refunds are handled according to Apple App Store policies. If you receive a refund for your Premium subscription, your token limit will immediately revert to the free tier (10 tokens per week).

5. Acceptable Use

5.1 Permitted Use

You may use the App only for lawful purposes and in accordance with these Terms. The App is intended for personal, non-commercial use to help manage food items and reduce food waste.

5.2 Prohibited Activities

You agree not to:

• Use the App in any way that violates applicable laws or regulations
• Reverse engineer, decompile, or disassemble any part of the App
• Remove or modify any proprietary notices or labels
• Attempt to circumvent the token limit system
• Abuse the AI features for purposes other than food management
• Sell, resell, or commercially exploit the App

6. AI Features and Data Accuracy

6.1 AI-Powered Recognition

ClearEats uses AI technology to scan and interpret information from food packages, including expiration dates and allergen information. While we strive for accuracy, the AI may not always correctly identify or interpret this information.

6.2 User Responsibility

You acknowledge and agree that:

• ClearEats provides estimated information and should not be relied upon as the sole source for food safety decisions
• You are responsible for verifying all expiration dates and allergen information by reading product labels
• You should always inspect food items for spoilage regardless of tracked dates
• ClearEats is not liable for any illness, allergic reactions, or other harm resulting from reliance on the App
• When in doubt about food safety, you should discard the item
• The App is a convenience tool, not a food safety guarantee

6.3 Allergen Information Disclaimer

IMPORTANT: The allergen detection feature is provided as a convenience tool only. If you have food allergies, you MUST always read product labels directly and consult with healthcare professionals. Do not rely solely on ClearEats for allergen information, as the AI may not detect all allergens or may incorrectly identify them. This feature must be explicitly enabled in Settings and is only available to Premium subscribers.

7. Intellectual Property Rights

7.1 Our Rights

The App, including all content, features, functionality, software, and designs, is owned by ClearEats and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our express written permission.

7.2 Your Content

You retain full ownership of all images, data, and content stored on your device. Your data remains on your device and is not uploaded to our servers. When you use AI features, images are temporarily processed but are not permanently stored.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains our privacy-first approach. The App stores all data locally on your device, does not require an account, and does not collect personal information. By using the App, you agree to the practices described in the Privacy Policy.

9. Disclaimers and Limitations of Liability

9.1 "As Is" App

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 No Warranty

We do not warrant that:

• The App will be uninterrupted, timely, secure, or error-free
• AI features will be 100% accurate or reliable
• The quality of the App will meet your expectations
• Any errors in the App will be corrected

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEAREATS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App
• Any bugs, viruses, or other harmful code
• Any errors or omissions in AI-detected content
• Loss of locally stored data due to device issues or app deletion
• Food spoilage, allergic reactions, or illness resulting from reliance on the App
• Inaccurate expiration date or allergen detection

10. Indemnification

You agree to defend, indemnify, and hold harmless ClearEats, its affiliates, officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

11. Modifications to the App

We reserve the right to modify, update, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App. Your locally stored data will remain on your device even if the App is discontinued.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms and updating the "Last updated" date. Your continued use of the App after such changes constitutes acceptance of the new Terms.

13. Termination

13.1 Termination by You

You may stop using the App at any time by deleting it from your device. This will permanently delete all locally stored data. If you have a Premium subscription, cancel it through the Apple App Store to avoid future charges.

13.2 Effect of Deletion

When you delete the App, all locally stored data (food items, images, recipes, preferences) is permanently removed from your device. We do not have backup copies of your data since it is stored locally only.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the App shall be resolved in accordance with the laws of your jurisdiction and Apple's App Store terms.

15. Apple App Store Requirements

This App is distributed through the Apple App Store. Your use of the App must comply with Apple's App Store Terms of Service. In the event of a conflict between these Terms and Apple's terms, Apple's terms shall prevail with respect to your use of the App Store.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ClearEats regarding the App.

16.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
